In 2012, after superstar Rajesh Khanna passed away, his alleged live-in partner Anita Advani filed a domestic violence case against the former’s wife Dimple Kapadia, her two daughters – Twinkle and Rinke Khanna and son-in-law Akshay Kumar. In her complaint, Ms Advani claimed that she was forced to leave Khanna’s Aashirwad bungalow. And she demanded that she should be allowed to re-enter the iconic mansion. In defense, Dimple Kapadia pointed out in her petition that since she and neither any of her family members lived with the complainant at any point, they can’t be charged under the Domestic Violence act and therefore the proceedings should be dismissed.
Defending Dimple and her family in the case, senior counsel Shirish Gupte and Mahesh Jethmalani argued that late actor’s live-in partner cannot claim relief under the Domestic Violence Act and maintenance as the Finding Fanny actress and her family didn’t live with Khanna nor with Ms Advani. They also argued that since Dimple Kapadia was Rajesh Khanna’s legal wife till the end, only she had the right over his wealth. Justice Tahaliyani squashed out Rinke’s name from the case after hearing all the arguments as he thought she had nothing to do with the case proceedings since she was married and living in Kolkata . In fact, Anita Advani’s lawyer Mrinalini Deshmukh also agreed with the decision
